  1. It may just be the rough drawing. Extending off the side of the bay wouldn’t be PD as it would project forward of the principal line. It would need to come off the main wall line, which appears to be approx. 600mm back.

  3. Sorry @Ferdinand, haven’t long seen this. Under PD, original is how the house stood on 1st July 1948. @Jonathan M If that bit on the side is original/has been there since 1948, then what you are proposing would require Planning because one part exceeds 4m deep. If that bit on the side is not original/built after 1948, then what you’re proposing what constitute PD. The latter is referred to on Page 20 of the Technical Guidance.

  5. The height is irrelevant. An outbuilding is an outbuilding. But you will find people putting up stores, sheds in their front gardens without Planning. Technically, they’re in breach but Planning would need to take a view as to whether they would take action against it. It only needs a neighbour to report the potential unauthorised works.
  6. Because outbuildings forward of the principal elevation are not PD, irrespective if there was a shed/outbuilding there before.
  7. Not completely following your idea unless you have an existing and proposed layout? The shed itself will require Planning. Because if that, submit a Full Planning application and ask for permission for what you want. You’re then not limited as to what is and is not allowed via Permitted Development.
  8. A skeiling by definition is the straight sloped part of a ceiling and so it would be tested as a ceiling and therefore part of the roof element.
  9. Guarding is usually required when there is a difference of levels of at least 600mm so that would naturally be 3 steps.
  10. 2 layers of 12.5mm plasterboard or 1 layer of 15mm FireLine board achieve half an hour. The requirement will be covered under ADB and from memory, is included within the Appendix.

  12. It is as you mentioned… like the rules for a conservatory. Once you remove or replace the external quality door, it then becomes an extension to the house and therefore requiring BR’s.
  13. Ok, so I’ve now heard back from the Planning Officer about a neighbours’ application. They’ve instructed their Legal Team to revoke the Prior Approval. Ooops.
  14. Nope. They submitted a straight forward PA application, which was granted… even though it appears their PD rights were removed back in around 1980. Yes, a bit of a strange request.
  15. Right ok. Only reason I ask is one of my clients’ neighbours has gone through something similar. There was a condition from around 1980 that withdrew PD rights. Planning have since granted their Prior Approval application for an additional storey, which threw me. I have asked the Planning Officer if PD rights are not checked as part of the PA process and they haven’t got back to me yet. I’m pretty sure the Council have made a mistake. Although not an ideal situation for you and once you have the formal determination but more importantly, the Planning Officers’ report/assessment, could you link me to a copy?

  17. So did you submit a Prior Approval application for additional storeys, which was approved but the LPA then found an old condition which restricts PD and are saying they will revoke the PA? Or did you submit a Lawful Development Certificate for straight forward PD extensions, which that was approved and the LPA are saying it will be revoked?

  19. So you’ve answered your own question in terms of Planning. A replacement structure is determined as it being a new build. Technically, any upgrade works you carry out to it would still require Planning as the structure itself doesn’t meet PD. Don’t know how or why you’d even consider trying to upgrade that either.

  21. PD relates to the original/as-built house. So any new windows on what isn’t original would require Planning.
  22. Assume it’s no higher than 4m? Btw, the render alone will require Planning.
  23. @paul91 As mentioned, if the (proposed) extension meets the PD criteria, then adding windows and doors to it would also be considered PD. It’s slightly different to two/three storey houses but not bungalows. Btw, will any of the proposed extension have a flat roof because in the majority of situations, adding those to bungalows are not PD?
