You might want to have a read of this case. This relates to a self builder putting a claim in for a VAT refund rather than a zero rated developer built house but it’s worth a read. http://financeandtax.decisions.tribunals.gov.uk/judgmentfiles/j9302/TC05323.pdf Your builder may need to evidence that the property is a new build and he will need more than photo evidence. You run the risk that without the proper planning permission in place HMRC will reject the zero rating and the builder will want to recover it from you. VAT registered traders have to do quarterly returns so it won’t be long before your house will be on HMRC’s radar. When you say that your builder will be doing everything you mean buying and fitting the whole lot? You can claim the vat back yourself on eligible items you purchase even if the majority of the work is zero rated by the builder. -

Really? I thought it sounded like an arse uncovered word! Must be the legal minimum I guess. 'Implied' may be what it means, after all they gained permission to put the pole up (possibly) way back when. -

True, but a land owner does not have to agree to an easement that is registered by the Land Registry and more permanent, so a wayleave is better than nothing as far as the power company is concerned I guess. Wayleave vs Easement -

Sounds encouraging so far. Did a search. Came up with this one that says “bare permission” (search for the word bare in the document). Electricity Wayleaves Looked up bare permission in respect of wayleaves and found this match in a specialist book: Wayleave book And this definition of a ‘bare licence’ Definition of 'bare' Sounds like an informal right to do something that can be revoked. As a search tip, if there is a phrase you want to search for put it in quotes, “bare permission” wayleave for example will tell Google to look for the phrase ‘bare permission’ but also the word wayleave. That helps to get better matches and home in on something more specific. -
At least you can remarket it knowing that it’s getting sorted and hopefully this time round you will get a decent buyer.

There’s always a bloody get out. When my neighbour tried to sue her solicitor for screwing up the meaning of the burden (covenant) and giving the wrong advice she was told by a very expensive property lawyer that she wouldn’t be successful because 2 other solicitors had interpreted the burden in the same way therefore negligence would be difficult to prove. So 3 useless solicitors makes it ok to be wrong apparently!

Sliding gate would be more work getting the track installed etc. Best to stick to the double farm gate idea I reckon. So you've loaded the photo as your cover photo rather than your profile photo hence you can only see the green Z. If you click on your green Z you will go to your profile and see the cover photo. I can see your arse (and your elbow ) in it. The definition isn't great (which is probably for the best ..... !!). That's you and @pocster now in the battle of nakedness!! Hope you pair don't go using any power tools whilst in the buff. That belongs on a health and safety thread though! You need a much smaller pic to use as your profile. Once on your own page click on the box that says profile photo to the left of the green circle. Then upload a photo. To add a signature click on your username top right, then select 'account settings'. The bottom one on the list on the left is 'signature'. Click on that, add some text in the box at the bottom and press save. Voila!

And from some of the designs we see on here architects do not always have budget at the forefront of their mind. They may be set on creating the perfect vision rather than designing something that might be not that much different, but a whole lot more budget friendly. Not all architects but certainly some so keep a practical head on when looking at draft designs and think to yourself 'how will I build that', or 'how much will that huge steel cost'. If you don't feel qualified to assess this then you may need someone on board who can.- 10 replies

VAT or no VAT

As @jack says both are really services so full VAT applies. You might be able to argue that the MVHR is labour to set up the system but that would need to be a conversation with the company in question to see if they would zero rate it. No guarantee though. It you got them to fit something on a ‘fit and commission’ basis then it may properly be classed as labour and eligible for zero rating, but commissioning on its own is a bit of a grey area IMO. Air tightness test is definitely a service so VAT is chargeable and not reclaimable. -

Could be a bit more than that if it’s a CT scan, possibly MRI, blood tests, consultant appointment and follow up, and if he’s still dizzy it might not help much even with a diagnosis. -

I bought the plot here with full PP and a building warrant. We did not have the rights to the drawings. When we engaged a TF supplier they drew up new diagrams anyway as part of the supply package (as in it was within the supply cost). The frame has to have structural calcs done so they had to do that anyway, plus we changed a lot of the internals so joist plans etc all needed to be altered anyway. -

How to quieten a fridge freezer in an open-plan living room?

One of my 2 fridge freezers (built in) is making a terrible whining noise off and on so I imagine there is something wrong with the compressor. Anyone know if these days it’s worth getting that sort of thing fixed or just bite the bullet and replace? Are you private building control or council? The council just emailed me copies of whatever I wanted if I asked them (although we did get the drawings from the TF company). -

What if you need to alter something requiring a new drawing being passed to the council? People change their minds all the time during the build (well we did). How do you stand then? -

Just be careful that you don’t fall foul of HMRC with their new interpretation of ‘complete’. If you can get in writing from BC that the Hetas certificate is required before sign off can be given that may help if you are challenged.
