I think it will be very doubtful that you will get permission. Put in an application and see. That is the only way you will find out.

The application is already in place. If they reject us, we will appeal to the planning inspectorate.My question is if we gets rejected by the inspectorate are we able to submit a new application in future ?

Thanks for the info. I didn’t know that we could apply again. Another question, are we allowed to resubmit without going for appeal after the decision?

Kerbs are there to curb wheels going onto the pavement.

You do not have an application in for a dropped kerb. That needs to be your next step. If you don't do this your current application is likely to get refused. As the council has deferred your application, speak to the planning officer and ask her to hold your current application untill you put in a application for a dropped kerb and get an answer of that.

First step. fill in an application for a dropped kerb........Ask the planning officer to hold your current application untill you get an answer on your new application.

You may need to employ a specialist to help you with the application for a dropped kerb.

Thanks for the advice. I will ask the planning officer. Dropped kerb applications also need planning permission, or is it issued by a different department? I have read somewhere that dropped kerbs also need planning permission.

Hi everyone,

Today was the second committee meeting. I didn’t personally attend the meeting, but I watched the whole thing on YouTube.

So the scenario is that we have backed up all the concerns raised during the previous meeting regarding visibility splay and the likelyhood for VCO. The highway authority visited the site, and they are happy with the visibility. They also recommend obtaining a VCO licence, which means it’s very likely to get thr VCO licence.The planning department is also favouring the application.

During the meeting today, even after submitting all the supporting evidence, nearly 18 members objected to the application, with 1 member in favour and 4 abstain. The reason for the objection was that the proposed development could result in the loss of on-street vehicle capacity due to the development of the amenities of the local residents.

 


 

can some one please give me your suggestions please.

does these objections  means this application will be rejected?

My understanding is that the planning committee's decision is final as far as the local authority goes. You do have the right to appeal to central government. From what we have seen they are less interested in minor details and more interested in the politics of getting more houses built under their watch.

If your planning committee is the same as ours they have little knowledge of all the laws and a lot of interest in petty politics.

This was the second committee meeting. In the first one, they raised issues about visibility splays. When we have the backing for that, they brought up this new issue: proposed parking would affect neighbouring amenities.

I feel sorry for the head of planning, as these members don’t understand anything. It was very clear that the members just wanted to favour the 18 households.

Hi all,

I hope you guys remember the post that I posted last year regarding Garrage conversion and parking the car in the rear garden. I am glad to say that we won the appeal, and the highways gave us permission for a dropped kerb. Now the real problem is that the neighbors are not happy with the approval, and they are trying to be problematic with us. One of the neighbors swore at us while the tree surgeons were cutting two ornamental trees in the garden last week, and since then they have parked a car where we plan to construct the dropped kerb. They haven’t moved the car since last Friday. They already know that we are going to construct the dropped kerb soon. The contractor contacted me today and said they were going to start the job on Monday. I am sure they are not going to move that car anytime soon. 
I called the council this morning, and they said they can’t interfere in civil matters, so I called the police, and they said to leave a polite note in the windscreen to move the car for construction. Also, they told me to call them if they didn’t move the car when the contractor was here; they said they would try to find the registered keeper of the car and ask them to move the car. 
I also know that as long as the car has a tax and MOT, they can park on the public road. I just don’t know what to do now. I really appreciate your guys thoughts. Is there any possible way for me to sort out this issue?

Congratulations on getting the approval.

 

I would do as the police say. Make it a polite note and mention that you have taken the advice of the police.

 

There is a law that prevents people from blocking driveway exits with their car. They can block it if the driveway is empty but not if there is a car parked in there. Can you maneuver a car into position where it needs to exit from the proposed new driveway?  Now that you have gained permission for yours it may well cover you in your situation. You will have informed them of the approval that you have for a driveway entrance and they are now blocking you from exiting it.

I would question that, if I returned home to park on my drive I should be able to have access surely?

I asked the highway regarding this, and they said you can only call the police if you are inside your driveway and you can’t get out. If you are outside and you can’t get in, no one can do anything.

No there is no space to drive a car inside. I think in our situation we don’t have right to drive a car across the kerb without finishing the construction of the new dropped kerb even though we have the approval .

Now i have seen the picture, even if that particular car moves, another one will promptly fill the vacant space.  The only way you will "reserve" that space for the workmen is park your own car there, and don't move it.

 

I can see this will be an ongoing battle even when built, there will be a lot of resentment that you have taken 1 "public" space away in order to create 1 private space for you.  I expect you will frequently find it blocked, sometimes blocking you in sometimes blocking you out.

 

Been there done that when i lived with my parents, frequently had to call the police to get a car moved to get out.  At least the double yellows meant they could slap a parking ticket on it as well as move it.  But if there are other cars parked right up to it. they can't just push it down the road a bit, so unblocking your drive will probably require a truck to come and lift it.

 

Best of luck but I fear you have a bumpy ride ahead.

Many of us have got an elderly disabled relative. Perhaps ask council if they can yellow line a short section so you can access your driveway when your elderly relative is staying...

It appears everyone is parked wheels on the pavement both sides. Would the road be too narrow for an ambulance or fire engine if cars parked fully on the road both sides? That might be an argument for making one whole side of the road no parking? But that would make you really popular.

 

Pavement parking is illegal in London but elsewhere the rules are mixed. I suppose it might give police/Council the power to move the car when they otherwise cant?

Hi all, Finally, we managed to start the job this morning. They dug out the old curb and installed a new one. Tarmac will be done by this Tuesday.

They moved that car last night and replaced it with another one, and after they parked the other car and went inside their house, the only good thing was that I found out which house the car belonged to. It was so dramatic this morning when the contractors came and went to knock on their door, but they didn’t open it. It was 8:30 in the morning. Again, they waited another 10 minutes and received no reply. The contractors said they didn’t think they would move the car, and they were about to leave. I decided to call the police, and today they were so helpful. They called the registered keeper and told them to move the car. By that time, I also went there and asked them to move, and finally they moved the car.

Once they started working, most of the neighbours came out, and they were not happy with the sound they caused. They demanded to see the permission from the builder, and the builder showed it to them. Most of the neighbours went in after seeing the permission, but one awful neighbour started arguing with me; he said I checked the council website and there was nothing he could see regarding the permission. Bla Bla Bla, finally, I told him that I didn’t want to explain to you anything; if you have any problems, call the police, and he silently went inside. 
I have installed a camera there, and now I can see that each time they pass, they stand there, looking at the curb, and moan. I hope they will settle within a few weeks or months. Anyway, I felt so happy.
