Hopefully a step forward but not finished yet.............. While on site yesterday, I saw them measuring and marking up for the access road. The site guy who works for the developer was there and also the guy who's doing the work. They both confirmed the following: The access road will be built to take 60t, the same as any other road whether it's adopted by the council or not. Construction vehicles are no problem. It has to be able to take full fire rigs and I assume more than one if there's a big fire. The guy doing the work said if anything moves or sinks in this road, they have simply done something wrong as it shouldn't move in any way. They will be using 80mm blocks. They said that all I would need to do is clean up any concrete that may spill, which obviously I have no problem doing. So I've emailed the developer with all this and asked him to confirm it. I've also called him to see if this can be dealt with and put to rest as we all want an easy life. He's going to read the email, speak to his site guy, then call me back. I genuinely hope he can just confirm in writing what his guys have said, he's always been reasonable so I don't understand why this wasn't confirmed and wrapped up ages ago. But if not, I have no choice but to inform planning enforcement if they start work because I have to cover myself.- 70 replies

If you mean the access road, then it's owned by the developer which is a Ltd company but I believe this is a tiny fish in his pond, he's used to doing much bigger developments- 70 replies

There is nothing on the plans apart from Tegula block paving described as the finish. The only detail there is is where they have to use cellweb for tree protection over part of the road. I have asked for this detail numerous times but haven't succeeded in getting an answer. No rubbish lorries as bins are emptied at the front, but yes someone could potentially have heating oil. It is a private road and will remain a private road owned by the developer.- 70 replies

I've no real dealing with planning enforcement but how could they not care, it's a pretty definitive condition and pointless if someone decides they want to ignore it. If it relates to safety and access, then that doesn't go away until construction work is complete surely?- 70 replies

I thought about it and completely agree. If I mention doing the road to a certain standard, I'm condoning the road being built and supporting his actions in some way. I'm sure they do but double checking, do planning conditions last until the end of everything being signed off? The decision date was Feb 2013 and just wondered if it was a coincidence that it's just over 5 years- 70 replies

Already done. I emailed it to him Sunday night and posted it signed for yesterday. He's already replied to the email though saying if I damage the road it is my responsibility to repair it- 70 replies

There is nothing in the contract about road damage. It only says that all the plot owners have to maintain the road. He has since said by email that if anyone damages the road (which he still owns) then they would be responsible for the repair- 70 replies

I would hope so but the developer is not very forthcoming with capacities of the road. I'm trying today to find out the exact makeup of the road. There won't be bin lorries but you're absolutely correct with other heavy duty vehicles. Plus it's down to how well it's done I have been told it should be a "small estate road" which would use 80mm blocks instead of 65mm on a 225mm type 1 base and 50mm sharp sand- 70 replies

A base was put down and has been there for some time while the other houses were built. Road protection mats would cost a fortune and probably more than any possible repairs. The road is around 100m The last 2 plots are in the same position and I've emailed the owner last night to get his opinion on it as he was trying to sell it- 70 replies

Hi, Desperately need some advice. My plot is number 3 out of 4 on a development. The developer is contracted to block pave the access road into the 4 plots in block paving, which is about 100m long. 2 of the houses are complete, 1 hasn't started at all (and not sure if it's even been sold) and I'm in the process of building. I received an email from the developer last Friday telling me they intend on constructing the access road starting the 16th. This may possibly cause me huge issues as delivery vehicles, concrete lorries and a crane could damage the block paving. In my contract under sellers obligations is the following: "No later than 3 months after the last house on the any adjoining land (then or formerly belonging to the seller) which is practically completed the seller shall at its own cost surface the said access road using block paving or such other materials as may be required by the local planning authority" Now my understanding of that is within 3 months after the last house of the 4 is practically completed, the access road will be constructed and not before. I've pointed that out to the developer but he is still going ahead with the access road and told me that I will have to pay for any damage. Can that contract clause mean anything else? Am I reading it wrong?? Thanks for any advice Vijay

I feel sad for you that you have to deal with crap like this. They can see your house and what you're trying to achieve for your family and think it's OK to charge a probably descent chunk of money and give you a crap job. I can assure you, you will always notice those ripples and marks if you leave it. I had a plasterer recommended to me my a neighbour who was in the trade, apparently this guy did a lot of work in Hampstead houses and was spot on. He did the plastering in my loft conversion and a few other walls and it always annoys me when I'm up there. there are marks exactly like yours - and it was done 20 years ago!!! It's a real shame that these "professionals" can't see how bad their work is and are happy to have no pride in what they leave a customer
