Planning conditions still outstandingšŸ™ˆ

Good morning i now have a builder lined up for starting in feb but have now found two outstanding planning conditions that i was told had been taken care of by architect but i hadnt checked until now so my fault, i will paste below, has anyone on here delt with similar matters before or know a rough timescale for setting these right? I will get in touble if i try to deal with these while the house is being built?

9. Prior to the commencement of the development hereby approved, a detailed
landscaping and planting scheme for the site shall be submitted for the written
agreement of the Council as Planning Authority. The scheme shall include details of the
height and slopes of any mounding or recontouring of the site, full details of all hard
landscaping proposals including materials and installation methods and, species,
height, size and density of trees and shrubs to be planted. Information shall be included
to demonstrate how biodiversity will be enhanced within the site. The scheme as
subsequently approved shall be carried out and completed within the first available
planting season (October to March) after the completion or bringing into use of the
development, whichever is the earlier, and the date of Practical Completion of the
landscaping scheme shall be supplied in writing to the Council as Planning Authority
within 7 days of that date. The scheme as agreed and implemented shall thereafter be
maintained to the satisfaction of the Council as Planning Authori

Development shall not commence until the applicant has submitted approved CAR
licence(s) under the Water Environment (Controlled Activities) (Scotland) Regulations
2011 for the drainage infrastructure associated with this project to the Council as
Planning Authority and the Planning Authority has confirmed receipt of the
documentation in writing

I've recently had to discharge pre-occupation planning decisions. the architect dealt with it for us as it involved submitting a detailed landscaping and planting scheme and he already had all the plans so didn't take long to update drawings. cost us Ā£215 to the council to discharge them! <expletive deleted> money making scheme if you want my opinion. my cynical self thinks they just add this shit on so they can get more money in their coffers.

The CAR licence you will have to do as part of the building warrant, you can't start before that.

The other is a plan that has to be drawn and then it is how long the planners take to process that.

the building warrant is passed a few months ago but the CAR license is still to be done?

or is SEPA consent something different from the CAR license?

only submitted a few days ago. we received a letter saying that they've received the application. not sure how long it will take for them to discharge the conditions though, sorry.

was it a condition that had to be met before the build could start?

no. these were pre-occupation conditions. we are demolishing the existing property after the new house is built so i submitted the demolition notice and the council sent me an email saying "we've received a demo notice but you've not discharged these pre-occupation conditions you naughty boy".

if your builder is starting in Feb i would say that's plenty of time to get the conditions discharged. i'd even go so far as to say that as long as the application to discharge is in place chances are it won't be a problem. but you've got 3 months so i wouldn't worry. just get it in as soon as possible.

Are you sure, waiting for the CAR licence from SEPA delayed my building warrant.Ā  Ask building control if SEPA have issued the CAR licence yet?

The architect said it still needed done when i spoke to him although the called a sepa conditionšŸ§

Can't comment on CAR but the landscaping plan shouldn't be too hard to put together and get approved. Just mark up a site plan.

Normally you write "Tree A" or "Hedge B" on the plan then on a separate "Planting schedule" you list each one in a table...."Tree A to be a standard size xyz species" or "Hedge B to be two rows of native hedge plant (whips) planted 60cm apart and protected from rabbits by plastic spirals". That sort of thing.

As its a planning condition any VAT paid on trees can be reclaimed if there is a landscaping plan.

Yeah the biodiversity stuff is more work. I'd suggest trying to find one from a similar application.
