Hass Posted January 23, 2023 Share Posted January 23, 2023 Hi guys New to the forum, love the content and advice so far. New to self build. I was hoping somebody could help advise. I am in process of potentially buying a plot, however planning approval was given March 2019, with a 3 year expiry. There were some pre-commencement conditions, some of which were discharged March 2022 (within the 3 year period) I understand if a start was made ie excavation, foundations, demolition this would mean planning will not have expired. however, would the discharge of some pre-commencement conditions constitute an enactment of planning? ProDave Posted January 23, 2023 Share Posted January 23, 2023 Make it a condition of the offer that the plot comes with planning permission. then contact the council to see if they believe the development has "started" If they do, the good. Temp Posted January 23, 2023 Share Posted January 23, 2023 If the CIL is a thing in your area check the status. Has it been paid? Normally a self builder has to apply for an exemption before work starts and live in the house for three years after completion otherwise it becomes payable. If not already paid, it's just possible you might become liable for the CIL with no way to claim the exemption because work has already started. This might mean it's cheaper if the existing PP has not been started. You could apply for new PP and claim the exemption before starting work on that one.
