  1. It is adjacent to a highway. And a highway can also include a public footpath. PD allows you up to 1m. Anything more would require Planning. But do your deeds state you cannot erect any fence without approval? If so, then that would theoretically take away your PD rights and any height fence would require Planning.
  2. It sounds like you have changed the use of the public amenity space to your private residential garden and enclosed it. Just because you may legally own that space does not necessarily mean you can use it as part of your residential garden and curtilage. You need to check the original Planning approval for the site and see what that piece of land is defined as. If the above is correct (public amenity), then you will need to submit a Full Planning application which includes the change of use.

  4. PD relates to the original/as-built house. The existing two-storey at the rear is already at the limit. Anything you add to it would require Planning as the “resulting” extensions would not meet the PD requirements.
  5. A bit of a c*ck up by the plumber I’m afraid. You can’t just go cutting into or destroying the thermal envelope of a building so things can “fit”.

  8. You don’t need a 350mm wide cavity wall in order to meet the BR’s. Is the potential hassle worth it over 200mm? What room(s) will the extension be accommodating? Does your LPA have policies when building two storey side extensions towards the boundary? Most require a min. 1m gap for at least the first floor element.
  9. Most LPA’s would expect as a minimum for you to submit a LDC application, which confirms what you can do via PD. You then go back into Planning with a Full application cross referencing to the PD fallback position. Are there any other site restrictions that could limit your PD proposals?
  10. No more than 50% of the land around the original house should include extensions or outbuildings. Will the conservatory connect to the two storey side extension or will it be on the back of the original/as-built house only?

  12. Depends if you do want to Appeal which can take around 6mths and with the possibility of it being dismissed. Or accept the re-location and seek approval for something. Where is this 5m rule/policy mentioned in your LPA’s guidance?
  13. Good luck as it sounds like you’re going to need it. Just don’t keep changing your mind once the works do eventually re-start as you’ll be back to square one again.

  16. Install a timber framed wall with a brick outer skin… like I said. It achieves the required u-value and the existing foundations are irrelevant.

  19. It isn’t something I really want to get involved in, especially from my business/company point of view. You’d be better off reaching out to a local Party Wall Surveyor and sooner rather than later.
  20. Obtain a few quotes and then you’ll know the approx. cost. Far too many variables to compare to what others have paid.
  21. As you’re within 10m, you will require specialist foundations (which you already know and have confirmed). The answer to your question lies with a structural engineer.
  22. Get in contact with a PWS and ask them to assist you in serving him with an injunction. After all, you’ve stopped building… he hasn’t. If he’s wanting to be difficult, so can you. I can’t believe BC are asking for a current and compliant wall to be put back in the position of the existing. Primarily because you’ve stopped and are no longer proceeding with the works. If however BC are insisting on this compliant wall, then you can do that with a timber stud/frame wall. You could render or just clad the external face as opposed to utilising brick as brick is more likely to make the overall thickness worse. You need to speak to and engage a professional. It’s too detailed and complex for A.N.Other to get involved in. This could turn legal.

  25. No. Your options would be to reduce the depth of the extension, increase the depth of the extension or provide new foundations beyond the sewer and lintel over.
