Barbara Posted August 17, 2021 Share Posted August 17, 2021 3 years on 2nd architect and 25k down in fees?I went ahead with 2 dormers on a property in Leeds which has been rented out to private tenants to now once again getting hassle from planning due to size and cladding (Yes I had them bigger than existing 30year old ones!and now have been informed as I had applied for class M on the shop below which is change of use to residential that the dormers were not classed as a retrospective build?under class M now they are threatening enforcement order to have both dormers removed?Yes scary stuff so any one who can advice me on this please do thank you. Did you get planning permission then change the use after you built? it seems a bit confusing to me because once you get permission you can’t lose it as far as I know? maybe if you could say what you did, in the order you did it…? Temp Posted August 21, 2021 Share Posted August 21, 2021 It's common for the planners to send a letter stating they intend to issue enforcement proceedings. The key is to find out what they want you to do about it. Sometimes they think you need Planning Permission and are likely to grant it. Sometimes they really want the building work reversed. Sometimes they want changes. Ask them. If they say you need planning permission but they are unlikely to grant it and want them removed I would find yourself a local Planning Consultant. Because I was told planning permission was required for dormers but they did not tell me planning is only required for dormers on the “principle “ elevation (road facing).
