flanagaj Posted 14 hours ago Posted 14 hours ago So we had the following condition "The development hereby permitted shall not be occupied/brought into use until there has been submitted to the Local Planning Authority verification that any identified asbestos has been removed from the application site and disposed of by a licensed asbestos contractor in accordance with the Control of Asbestos Regulations 2012. REASON: To ensure that all asbestos on the site is removed to protect any future occupants of the site and current occupants of adjacent land in accordance with Policy EM12 of the Basingstoke and Deane Local Plan 2011-2029." There was some sheeting (not even sure it was asbestos) from some old duck houses. I stacked them neatly and then paid nearly £500 to have them removed by a registered asbestos waste carrier. I then stupidly submitted a discharge of condition for said asbestos and submitted the invoice as evidence. What a mistake that was!! Environmental Health, then came back wanting photos, waste carrier transfer notice. They have now requested an extension (I've told them to get stuffed) I think they need to have reworded the condition, explicitly stating that photos need to be submitted along with the waste transfer notice. I bet it's some spotty teenage oink making it up as they go along. 1
Pendicle Posted 12 hours ago Posted 12 hours ago Sorry I agree they should have worded clearer but my understanding is that it’s mandatory for licensed operator to provide documentation certifications that asbestos has been disposed of safely and not left at the side of a road. Lots of cowboys out there and licensed operators with documentation helps us all. You don’t say what kind of asbestos it is, some it’s perfectly fine to remove yourself while taking precautions others only license operators can remove but no matter what asbestos it was all need to be double bagged and tapped with care with full PPE. If they are licensed asbestos operator they should be still able to provide you with documentation certifications requested, so that element could be easily resolved if they were licensed to dispose of asbestos, although normally they are removed in asbestos’s skips after being double bagged and taped. The request for photos I know you can’t provide but maybe if you provide a risk and method statement of how it was removed that may go as far to satisfy them! For anyone out there reading this, best practice, No only practice, is to first get a survey to find out if indeed it is asbestos and what kind it is. If it’s a building being demolished a full survey by asbestos surveyor is advised. If you have a corrugated roof panel on a shed roof or garage or some artex you want to remove, you can get testing kits easily and cheaply on line where you send a sample to get tested and results emailed quickly some even provide PPE. My grandad died of asbestos related condition after installing in houses in the 60’s my dad is a licensed asbestos operator and removed from said houses 30 years later. For context, we were demolishing a 1960s house. We had an asbestos survey which advised we had asbestos panels in the kitchen and utility but it was the kind one can remove yourself and did not need a licensed person to remove. I wrote a method statement and risk assessment which you can also find on line, I did this for my own sanity but also to demonstrate to anyone who was interested ie local authority that we were taking full precautions for its removal. We had full PPE and took care and time to remove and double bag and tapped everything and then put into designated asbestos skip, as many have done here. During demolition we found corrugated sheeting in the garden and material under the fireplace that we suspected to be asbestos so we treated as asbestos as a precaution. We also got a testing kit for the board we found in the basement, test came back clear which made disposable easier. After skip was removed we got certificate to say where and when it was disposed which we forwarded onto the local authority. 2
