Planning permission for a car park

I have looked at several google searches and I have contacted my local planning office in my area and had no response! I asked them if they had a public register of current planning usages for certain plots of land in the area and if I could see it and had no response!

 

The land at current is hard standing concrete, To the best of my knowledge there was a workshop building in place there that was demolished about 20 years ago by the council because it was unsafe! I wish to rent the land off as parking spaces for people to park cars on it for the day (music and football stadiums very close by). What planning would I need? Anything ells?

Where did you hear this one from?

I think what Mr Punter was trying to say is that you could use the land for up to 28 days in any calendar year for a "temporary use" - in your case a car park. You could then rent out car parking spaces on those days without needing specific planning permission. This is all assuming you own the land or have a legal right to occupy it and thus charge third parties for their parking.

So what di i need to do for more then 28 days then?

You would need planning permission because there would be a change of use of land from what it is at present, which is probably nothing as the workshop use ceased 20 years ago, to car parking. Car parking is a stand alone use (what planners call sui generis) and thus always needs planning approval if the land has a different use.

 

Of course it takes the wheels of an LA a while to get turning. Several years ago people made considerable sums from using vacant land near Stansted Airport for car parking without permission before Uttlesford Council could commence enforcement action and then changing locations to thwart such action. If I remember correctly I think the Council resorted to issuing Article 4 orders for large areas to prevent rogue operators playing the system.

 

This is not an encouragement to do this here however.

I have looked at the planning portals web site and i can not see anything under the types of use for a car park,

How long do you think the application should take?

As I mentioned, car parks and some other specific uses such as casino's do not fall into the usual groups of uses and thus are treated separately on a case by case basis. The planning fee will be determined by the site area and the application would be for the change of use of land to car parking or some such form of words (the LA may change your description to one they think better fits). It'll take at least 8 weeks and you'll have to check the Council's website to see what information they would expect to see submitted with the application as that time period doesn't start until they have all they require.

What is an LA?

LA = Local Authority - i.e the body that will determine the planning application (could be a National Park Authority). An applicant is required to serve notice on the owner of the land, however owner includes a tenant with 7 or more years of lease unexpired, so presumably if you are a tenant with longer than 7 years left on your lease you don't need to serve notice on yourself. However, the lease may of course restrict a tenants ability to do what they want to do without the owners permission.
