*Follows on from previous thread - pls merge if necessary* We are all go for the extension in terms of builder/quote etc.

The side extension will go right up to the boundary with next door. The foundations will be around 4m away from the outer part of their wall. 

 

Yet to speak with the architect (assume they will advise) but is a Party Wall Agreement 100% necessary if digging 4-5m from their own foundations?

Between 3 and 6 meters you use the 45 degree rule from your neighbours bottom of foundation. Even taking it from your neighbours ground level, at 4 meters away you would have to be digging 4 meters down. I doubt that so you are good to go. Make sure that nothing on your extension overhangs the boundary. Gutter etc.

On reflection; there is a small part of the neighbor's side wall that is within about 2m of our wall (10% of total extension). 

 

Is my online reading correct in that so long as we do not go deeper than their foundations it is OK?

 

The 3-meter rule means notice must be given if you plan on excavating deeper than a neighbour’s foundation within 3 meters of any part of their property. You must provide notice in writing. In response, adjoining neighbours must provide written consent before work can take place.

Within 3 meters as long as you are not going deeper than your neighbours foundations, then no PWA required. Be nice to your neighbour. You need the fence taken down, and will want access in order to point up your wall. YOU need to take responsibility for not building over the boundary. Don't leave it to others.

@Big Jimbo ‘s ‘Be Nice To Your Neigbour’ is a very important message. So many projects start with arguments and confrontations and it goes down hill from there. Involve your neigbour, confirm the boundary and as above, make sure you stay on your side, your Archi or SE or BCO can all disappear and leave you sorting a mess out.

plus your builders will need access on their land, stuff will fall into their garden, something will get damaged, dust will be annoying etc etc. get the neighbours on your side and keep them there.
