Prior approval under permitted development

Hello Dear Members

 

One year ago we made an application with the local council for prior approval for a 4 meter single story rear extension under permitted development with the required drawings. This was validated by the council and we got the approval with the decision as 'Prior Approval Not Required'.

 

However due to all the events that took place in the word last year, we could not proceed with the work.

 

Now we are planning to go ahead with the work, but with slightly altered 3 meters extension instead of the original 4 meters. There are no other major changes in the structure of the extension, except for internal layout. We do plan to get new drawings done for the purpose of Building Regulation Inspections and builders work.

 

The question is, do we need to reapply to the council again for prior approval under permitted development, or inform the council any any formal way ?

 

Or can we proceed with the approval we already got previously ?

That means your house is probably detached. You don't need prior approval unless your house is detached and the extension is over 4m or semi detached and over 3m.

Probably not. It sounds like this would be Permitted Development (eg no planning permission or prior approval required). Did they say your original application would be Permitted Development when they approved it? 

 

To be sure its Permitted Development we would need more details or you would need to go through the rules here..

If you want absolute certainty you can apply for a certificate of lawful development. It's similar to a planning application but the planners would just check it meets Permitted Development rules. They can't reject it on subjective grounds.

To answer your query above; They did not specifically mention if this was permitted development or not, but we did go through the laws and believe it does fall under permitted development. I have put the details below with a sketch I made for the builders. Perhaps you would be so kind to take a look and give your opinion:

 

Ours is a 3 bed semi-detached property.

The extension is a single story 3 meters to the rear in length and the full width of the original house.

We want a pitched roof, but will not exceed 4 meters in height.

 

I hope I have given you enough information here, but let me know I you need any more details.

Your PA application only relates to the 4m extension. Any changes to that design would invalidate the PA application.

 

As you are now only wanting to extend by 3m, you can just get on with it by submitting a Building Regulation application. If however you would like that added piece of mind that the proposals constitute Permitted Development, then you would need to submit a Lawful Development Certificate application.
