Can I fill in a 1m side space that the council instructed I have, in between the flank wall of my home and the neighbour's?

During my extension I was instructed by the council to have a 1m side space under their Unitary Development Plan to prevent the area looking over crowded. I have had a plastic and wooden lean-to with a gate in this space, but would like to have an asphalt roof instead. Is this technically filling in the gap with a more permanent roof and would I be breaking the rules on not maintaining a side space?

Sounds like filling in.  Maybe would be OK if you set it back a bit from the front wall?
