S106 clarification

It seems that while we were away the Court of Appeal gave its view on the long running S106 saga. The appeal court has upheld the original government exemption for self builders overturning the previous high court ruling.

What do they mean by "small sites".

Would that apply to building eg 2 or 4 houses on a third of an acre?

If I remember correctly a small site is defined 10 units or 1000sqm.

Frustrating that they are going to appeal by the looks of it (Supreme Court..!) and waste more tax payers money ..!
