Nudura external retaining wall

Hi my Building Control guy is asking to see the tanking applied to a large external retaining wall, is this really necessary as its not part of my house.  The house walls that are underground do have tanking so are OK.

 

He has admitted he sees very few ICF houses so Im looking for evidence that says its not necessary.

 

Pictures taken during construction dont show any tanking and my builder is no longer involved and hard to contact.  As he handled all material supply I dont know where he got it from to ask the suppliers.

 

I'm in Cornwall.

If the wall is not part of the house I do not see the issue.
