Lasted the test of time ?/Party Wall or not ?

Hi all,

 

First post for me and thanks for having me on here, handy site.

I have a question if I may...

 

I have a retaining boundary wall between me and neighbour of which a section was knocked over but rebuilt as was by my clumsy builders 25 years ago.

The join in places has little fractures and has slightly moved.

 

Neighbour has expressed wishes to get rebuilt but all builders I've appointed say it's certainly not dangerous and not going anywhere in my lifetime unless hit.

 

Can neighbour legally get me to rebuild?

 

Neighbour thinks it's my boundary wall too, hence wants me to rebuild...however in deeds although T is on my property diagram, section 6 in print paragraph more or less states it's s party wall.

I've run this paragraph by boundary wall and architects who also side that it is infact a party wall. Just the fences are mine.

( Neighbour also has had Lots of building done near boundary wall and on no point have served me a party wall notice )

(Oh I can add this section 6 paragraph if needed - ta )

If you are satisfied the wall is safe then don’t bother. If he has had building work done close to the wall without a party wall agreement then he is in the wrong and you can blame him for any cracking/movement.
