cutmle Posted July 16, 2021 Posted July 16, 2021 Dear All, My scheme consists of cladding (rendering) the front elevation of the property and a side extension under PD. The LPA have subsequently enacted a Conservation Area, effectively removing the right to execute the works under PD. However, I commenced the rendering works prior to the enactment of the Conservation Area so I am lawfully able to complete these. Critically I see the scheme as a whole (i.e. rendering and side extension together) therefore as such I believe I am permitted to also lawfully construct the side extension in order to complete the scheme. I would appreciate any view you may have on my assertions.
Temp Posted July 16, 2021 Posted July 16, 2021 (edited) For safety you could apply for a certificate of lawfulness on the grounds you started work before it became a conservation area. Include copies of any drawings and dated invoices you have. Edited July 16, 2021 by Temp 2
