Sorry!!

self build exemption granted, development commenced (minimal demolition only) local authority are happy everything is ok and within CIL guidelines.

plot subsequently sold to another self builder.

local authority now state self build CIL exemption is not transferable and new self builder has to pay full CIL.

That seems strange

While you can’t transfer the Cil

I would have thought the purchaser could successfully re apply

Providing he or she met the criteria

Self building to live in the house as main residence

Not intending to sell within three years of completion

You can’t transfer a CIL exemption to another person, they have to apply for a CIL exemption in their own right. If the LA determine that work has commenced then I guess that the point at which CIL exemption could have been applied for has passed.

Yes that’s how I see it, so the new owner would have to submit a new application, hopes it passed (the original development was won at appeal) and hope they are granted CIL exemption as self builders. All seems farcical.

do you think this situation could be appealed?
