  2. I have a quick question I am hoping someone might be able to give me a steer on.... Quick background. I have bought a plot, from a builder, who is going to build a house on it for me to a design he had made with a few additions and changes from myself. He has full planning permission and we are about to apply for the building warrant to start the works. The plans don't have a garage, and I would like to add one. I could get away with a PD after the house tis completed. But, I would like to place the garage in front of the front line of the house and also put a room above the garage so I would need planning permission. I assume I need to add this onto the existing permission (as it is still 'open') and that this would remove any VAT on the build? is this the case? Can I start a second planning permission whilst the house is being built (I think this is a 'no') Also..... 1) Can everything else continue to progress whilst I amend the planning permission for the garage? 2) Can I apply myself or should I / must I continue with the architect that designed the house and has been liaising with the planning department? The PD route would be easier, no doubt. But the planning route would give us the garage we want in the location we want it. Any and all thoughts greatly appreciated Jonathan
  3. If they refuse the permission can they remove PD rights ..... or can they only remove PD rights when they grant permission ? My current planning permission doesn't have any conditions on PD
  4. We are finalising our plans for the house and plot. I have (another!) question which I wouldn't mind getting people's thoughts on We have planning permission for the house but are now thinking of adding a garage Option 1 - build it to the side of the house - after the house is completed and therefore build as a permitted development (within height etc restrictions) Option 2 - go for another planning permission and build to the front/side of the house (i.e. in front of the house frontage) Couple of questions 1. I assume that I can't start the application process for the garage permission until the house is completed?? (I don't want to amend the planning permission for the house as this may delay our build start..... is that right?) 2. If we go the planning permission route and were turned down, can we then still go the permitted development route (the garage would be in a different location to satisfy PD rules) Thanks for any thoughts
  5. I am after some VAT guidance please It's a odd scenario A builder has a plot - now split into two plots and is building a house on each. We have purchased one plot and are engaging the builder to build a house for us on it. The builder is building a house on the second plot which he will see as a completed house. I assume both builds - completely new houses - will be free of VAT I also assume on the second plot, the builder will build the house, reclaim the VAT and sell the house With regard to our plot. Can the builder build the plot and reclaim the vat himself? (We are paying him a fixed fee). Or does the fixed fee we pay him attract VAT and we then reclaim the VAT? My concern is that, say the build costs him 200k plus VAT and he charges us £250k plus VAT ..... can we reclaim the VAT on the £250k or only on the £200k?? Any thoughts appreciated
  6. On the basis most meetings will be by video/phone, and the plot we have seen is own the West Coast, that recommendation would be great ProDave. I'd rather have someone that understand self build, than someone that doesn't but is local!
  7. Hello everyone, and thank you for letting me join this forum We are about to embark on a new build in Scotland. We have found a plot that we intend to offer on in the near future, and have also found a builder to basically manage the whole project. The plot already has planning permission and we are happy with the permission that has been granted and so will just continue with the build along those lines. If anyone can help, I am still trying to find a solicitor in Scotland (preferably Edinburgh) who has self builder client experience – I will need him/her to help with the offer and purchase of the land and also contracting with the builder. Does anyone on here have any experience, or would recommend, a solicitor? I have searched Google until I’m blue in the face, but can’t identify a solicitor who has worked with self build clients, at least not from looking at their webpages. If anyone does know of a solicitor and could let me know that would be hugely useful, thank you. So we will keep updating on here as we progress on here, and I’m sure we will also have lots of questions and requests, so apologies in advance! jonathan
