  2. the covenant is limiting the number of houses per acre, the original owner of the title no longer exists ( closed building company) but in principle there may be some successor in title.
  3. bit confused after initial discussion with Insurance broker . i assumed the insurance would be taken out before i submit planning , but his opinion was to take it out after submitting the plan and awaiting for intrerested bodies to claim title of a restrictive convenant. surely by then its too late to get insurance? whats your experience ? Rob.

  6. hi investigating some old covenants 1940/1950s and the beneficial owner of one is a Limited Company that has since closed down. is this enforceable ? as i cant see any "successors in title " mentioned. thanks Rob.
  7. Very helpful thanks - the original beneficiary was the owner of the farm at the end of the road who probably didnt want a lot of traffic in his road. but the road has subsequently become a cul de sac and doesnt even go to the farm anymore.

Hi found a potential restrictive covenant from the 1940s restricting number of houses that can be built on my plot. the original people in the covenant are all dead and the original property that the covenant was protecting has been sold off. So who will enforce the Covenant? Also I Believe its possible to get insurance against such claims ? Thanks Rob.
  10. thanks Nod,i did that . does that mean if a restrictive covenant is not stated in my deeds it cannot be enforced ?
  11. hi, Speaking to a neighbour and he said there is a covenant on the area (an old country estate,split up in 1940s) limiting plot sizes to a minimum. i cant see it referenced in my Deeds - are there any recommended companies that do such searches ? A solicitor would probably be a rip off as Im only in early stages of considering a build in my garden, thanks.
  12. i havent applied for planning permission yet as i wanted to get a feel for how Santander would view it. also i cant see how you can split the the title of the existing house without first getting the lenders permission ?
  13. hi my house is valued at 800k with 100k mortgage (santander) . Plan to build in my large garden, then sell existing house and live in the new build. Would large lenders consider this or does it need a specialist broker? thanks. Rob.
