  1. thanks all I’ll email, post and hand deliver it to legal and maybe inspector also. just been going thru the application and when it comes to certificate part, it doesn’t mention who been served certificates, just has address and postcodes, so you can’t see names or company names of who been served, some are lease holders as their address has been served certificate but strangely 3 lease holders have not been served certificates, their address is not included in application even tho land they are on is in the development like that others in the application gets strange each day this application

I like to say to everyone thanks for comments and help, we are not being troublesome to developermemt as we welcomed it, we even offered up our properties and they showed zero interest which was odd, we even asked to join the companies to develop together and still no interest. But there has been to many weird occurances to date. By the council especially and their members. I ask one other question as we been digging today and found a council document from last month published, and it states the site in question has air quality issues and that no developments will be permitted until air no2 levels drop to a level. does that mean it there for cannot be approved? Or can it still be approved but just not allowed to build. also when writing comments for the council is it best to put all issues in one single letter, or to make impact send a letter for each issue, so that it’s not lost in a body of text

We have but they don’t seem bothered to help. we even emailed mp but we all got bounce back emails that they are off until new year. snuck in this application during covid and Xmas, and only recently got the letter that’s majorly backdated . We have about a week to sort thru all the documents and Xmas period, we fear even if we get our comments in, they won’t be processed because of the holiday period
  4. Can masterplans and local plans then be passed with no commitee involvement? There feels like there is a done deal already made behind the scenes. surely master plans would require to goto a commitee due to huge impact and proposed schools and police/fire stations retail/commercial units it would now appear. it’s not like someone making a small planning application very odd

We have tried to see if can get legal but loads firms can’t have consultations due to covid and not enough time. we can only think best thing to do is contact council legal dept like mentioned above. we fee there needs to be an investigation as to many councillors have a strange link to the applicants so you think it all sounds fishy too

Can anything mention here be used for material planning considerations. we feel like a done deal has been made behind close doors, it’s not that we want to stop the whole development, but just so many issues, that at least we want it to goto planning commitee, or have it delayed or differed or even thrown out for time being. it’s just very odd esp as all our properties are 40-5 feet back, french cottage look and the overall size of our houses are bigger, which with plans looks silly with all these smaller houses and having either yellow bricks, red bricks .... then they have flats abound our houses or small houses..... one of the other residents has horsing stables and they have proposed a car park for flats right next their stables. as we all have larger gardens, based on plans we have potentially 20 properties overlooking us, as because the style of the houses in situ and size of land we feel people will naturally keep looking at our property because it will be so odd to them and we would feel constantly watched especially the other residents with horses, they already feel people in cars will try to annoy them, by spooking their horses with loud music, slamming doors, reving, etc plus they feel people would watch the horses as it’s a view

This and the above comment you made has been super useful thankyou. if for example we had a lot of information of issues for a ombudsman to step in and look on basis of the application and conduct of LA, if it held up the site would/could damages come against us for delaying planning or getting it deferred or not accepted, based on us raising the issues.

Hi so an argument of saying there is a covenant and they should be sticking to the building line of 50 feet back can be presented as a comment and argument but just saying there’s covenants of 2 houses only on a piece of land that proposes 20, cannot be presented.... am I right at understanding that

Oh really but they have used covenants before to deny applications. if a parcel has a covenant for properties having to be 40-50 feet back, and other properties are 40 feet back, don’t they have to be in keeping and abide to covenants as they know the covenants exist. But the plans are ignoring them
  11. Thanks for comments you have really helped out understanding the process. it’s odd we were all refused planning at some stages over years due to covenants, and the type of area and because we added 8 extra potential cars. just funny looking back

Various members of the council have been their advisors, and members of public affairs boards hired by applicants. as such council members have been very odd towards us all and our questions. also there are loads of covenants on the site which have all be ignored which all our properties have embraced not breaking.
  13. What’s the chances we make the comment, and they delete the file and resubmit one or the council remove it for them, as if the file never ever existed?
