A quick update, it’s been through deferral committee and it now off to full planning committee. At this late stage deferral committee are concerned over four quite key points that were all addressed in the preapp report and given positive support by the planning officer who stated they all complied with relevant planning policy? It is very difficult to get your head around.

i have used a planning agent. I presume I will just have to keep the faith.

Possibly because of a comment by the parish council that is in conflict to the opinion of the planning officer. it’s a development in the countryside but is permissible because it’s within a defined cluster. This was all stated in the preapp.

sadly very true. I have an application for a single dwelling, I received positive pre-application advice, the planning officer recommended approval, it’s subsequently gone to referral committee, now referred to full planning committee, I’m not sure what’s going on?

I would prefer not go down that route 😂

Can a planning committee refuse an application on its ‘merits’ even if the application conforms to all points of planning law? Do they have to adhere to policy or are they allowed to form their own opinion? thanks

Hi i was advised to submit a pre app prior to an outline application. Thinking worse case scenario if I receive a negative response from the council can I still proceed with an application and any possible appeal? I have built a property on the same site two years ago, which the decision was granted at appeal, I am hoping this has set a precedent or established a right to develop in that area? hope this makes sense thanks

Yes that’s how I see it, so the new owner would have to submit a new application, hopes it passed (the original development was won at appeal) and hope they are granted CIL exemption as self builders. All seems farcical. do you think this situation could be appealed?

Sorry!! self build exemption granted, development commenced (minimal demolition only) local authority are happy everything is ok and within CIL guidelines. plot subsequently sold to another self builder. local authority now state self build CIL exemption is not transferable and new self builder has to pay full CIL.

Hi first time poster, has anyone had any experience of or heard of CIL exemption liability being transferred? Is it ever possible please? thanks
