We just defeated a claim to remove some oaks. The neighbouring property concerned (on a different road) had an extension with minimal 1979 building reg foundations despite being built in the 1980s and a later conservatory with substandard foundations, all on clay. All the other houses on that road built in 1976 have all had subsidence many nowhere near the trees. What clinched it was another property even closer to the trees complained about the heave risk if the oaks were removed. In the end the insurers have backed down and will underpin. The heave point being particularly strong as the area is at the bottom of a hill and gets lots of run off.
