  1. On reflection; there is a small part of the neighbor's side wall that is within about 2m of our wall (10% of total extension). Is my online reading correct in that so long as we do not go deeper than their foundations it is OK? The 3-meter rule means notice must be given if you plan on excavating deeper than a neighbour’s foundation within 3 meters of any part of their property. You must provide notice in writing. In response, adjoining neighbours must provide written consent before work can take place.
  2. Thanks - Would you mind explaining the 45 degree rule? We will have to ask the neighbour to remove fence panels when the wall is built and architect will ensure that no soffit / gutter overhangs.
  3. The side extension will go right up to the boundary with next door. The foundations will be around 4m away from the outer part of their wall. Yet to speak with the architect (assume they will advise) but is a Party Wall Agreement 100% necessary if digging 4-5m from their own foundations?
  4. Looking at doing a side extension of around 25 SQm. It will not front a road and height restrictions are all good. However, our house has been extended previously (rearwards). So here is the situation & my questions: - I am aware of the rule that states that the extensions must be no more than 50% of the total area surrounding my (detached) property. - Our property is set back from the road. QUESTION: Can I include the area to the front of my property (up to boundary) in this calculation & also the areas at both sides? - House was build in 1884 so I am aware that the rule states the 'original' plot is as it was on 1st July 1948. Since that time (in around 2000), the back garden was split with another property utlising that space as their garden. QUESTION: Do I include the plot size as it was in 1948 or as it was in 2000 as my calculation? - QUESTION: Presuming that I am compliant with PD; can I instruct builders do start work or do I need to get a Certificate of Lawfulness and/or inform the Council?
